The Consell de Mallorca has announced the implementation of a comprehensive plan to fight against illegal tourism on the island. So far, the insular institution has located 6,192 ads of properties without license, which offer a total of 30,292 vacancies

The president of the Consell de Mallorca, Llorenç Galmés, has announced this morning, accompanied by the councilor of Tourism, José Marcial Rodríguez Díaz, the launching of an integral plan to fight against the illegal offer in the tourist sector of Mallorca, which aims to combat this activity, whatever type it is and whatever sector it operates in.

As detailed in a press conference, this plan will be based on a detection system promoted by the Intelligence Unit of the Department of Tourism, which with its own resources has allowed to obtain the first large list of illegal rentals currently operating in Mallorca. The same has been carried out with its own resources through a process of web scrapping -extraction of content and data from websites through software- through which Tourism has obtained a series of data that allow to have a list of properties against which it will be possible to act imminently. Specifically, 6,192 unlicensed real estate ads have been located, offering a total of 30,292 vacancies.

This will revolve around four main axes with the aim of triangulating to the maximum all the available information so that the inspection and sanction service has at all times reliable information to pursue this type of offer, has assured the insular institution.

The first axis will be related to taxation, since data will be crossed with the Government and the Tax Agency to detect possible eco-tax payments in unlicensed housing, and vice versa, which will detect illegal activity in certain properties.

Secondly, the tourism axis will be based mainly on the list obtained by the Intelligence Unit, since Tourism inspectors will be able to go to specific sites previously provided thanks to this list.

A third axis will have to do with urban planning, since in addition to a tourist or fiscal fault, there is also an urban planning fault, since a property is being used for tourist use when it is not, hence the importance of the list to detect these irregularities. The objective is to facilitate and cross-reference the data with the town halls so that later the town halls can prosecute these types of infractions.

The fourth axis will revolve around the marketing platforms with which the Consell will seek a commitment to remove from their pages all the illegal offer they may have hosted. Some meetings have already been held with some of them and the predisposition is very positive, as indicated by the Consell de Mallorca.

In order to implement this plan of fight against the illegal tourist offer, the Department of Tourism will make a total of 9 new hires to reinforce the inspection and sanction service. It also informs that it has launched an overtime campaign that will also allow to speed up the proceedings in process. In addition, legal staff will be transferred from other units to achieve a more efficient management of the sanctioning process.

Balance of actions in 2023

The Consell de Mallorca has taken stock of the inspection activity carried out this year and has revealed that in 2023 (data until September) a total of 312 inspection reports have been issued, which have resulted in 279 proceedings against dwellings in an irregular situation in Mallorca.

Of these files, 30 have already been archived, another 74 have already been closed because the offenders have paid the corresponding sanctions and another 175 are being processed.

This year 2023, 136 sanctions have been collected for a total amount of 1.79 million euros.
