The Govern has announced that it is preparing a housing emergency decree that will allow the division of large apartments and single-family houses with a minimum size of 60 meters in the case of apartments and 90 meters in the case of single-family houses. As well as the reconversion of premises into dwellings and the increase of heights. The decree will be approved this September
Among the main novelties, the housing emergency decree-law will enable, on a temporary basis, several actions such as the change of use of existing premises (commercial, administrative, etc.) in buildings on plots with permitted multi-family residential uses, for their conversion into limited-price housing; or the increase of the maximum densities, to create limited-price housing, in existing buildings or on unbuilt plots with permitted multi-family residential uses.
It also provides for the increase of the buildable height in existing buildings or plots with permitted multi-family residential uses, and the change of use to residential and land use of private facilities and still undeveloped, in both cases to create new housing at a limited price or subsidized housing. In addition, the change of use to residential use of obsolete tourist establishments or plots of land for tourist use incompatible with this use will be enabled, in order to create limited-price housing.
This has been communicated by the Government after the meeting of the President Margalida Prohens and the Councilor for Housing, Territory and Mobility, Marta Vidal, with representatives of organizations and professional associations in the field of housing, as well as the island councils and municipalities.
Conversion of premises into dwellings, increase of heights and division of properties to create new housing for every 60 m²
As explained by the Govern, these actions will allow to generate up to a maximum of one dwelling for every 60 m² of residential buildable area of the plot, in cases of conversion of premises and increased densities in multi-family buildings, and a maximum of one dwelling for every 90 m2 of residential buildable area, in the case of increased densities in single-family dwellings between party walls with first floor and two more floors, which currently cannot be subdivided.
The growth in height, under certain limitations, will allow up to one dwelling for every 60 m² of the surface area built by the project, and in the case of changes in the use of land for private facilities and tourist establishments, up to one dwelling for every 60 m² of surface area destined for residential use.
It also provides for the transfer of publicly-owned land to private initiative for the development of subsidized housing and public housing, a possibility already provided for in the current regional regulations, which, with the new decree, extends the maximum concession term (from 50 to 75 years) of the public bidding process and defines the building capacities.
Reservation of municipal powers
With this decree, local councils will be able to decide whether to partially limit or cancel the actions foreseen in the decree due to any circumstance that is agreed within their municipal competence.
