The Government of the Balearic Islands has issued a resolution that prohibits the commercial use of moorings granted for private use in regional ports. This measure is a response to the recently published national regulation, which allows private recreational boats to temporarily switch to commercial use. The resolution is based on the exclusive powers of the Autonomous Community over public port property.

According to the measure, any use of these moorings for profit-making purposes, such as tourist rentals of private boats, will be considered a serious offence. This will lead to the initiation of a sanctioning procedure and the immediate termination of the mooring authorisation. The regulation aims to preserve the balance between social moorings, intended for private use, and profit-oriented moorings, which correspond to commercial activities, according to the Government. For this reason, monitoring will be strengthened to ensure moorings are used strictly for their authorised purpose.

Private and commercial uses entail different needs

Ports of the Balearic Islands (PortsIB), an entity under the Ministry of the Sea and Water Cycle, highlights the importance of maintaining this distinction, as private and commercial uses have different and often incompatible requirements. Moreover, the measure seeks to ensure the safety of facilities and the protection of the coastal environment.

The resolution will be published soon in the BOIB and is already available on the Ports of the Balearic Islands website. Meanwhile, PortsIB has requested that concessionary entities submit, within a maximum of ten days, a provisional proposal outlining the distribution of moorings by use. The allocation must clearly distinguish between private vessels and professional activities such as yacht chartering or non-scheduled maritime transport.
