The Ajuntament de Pollença has opened a fine of almost 300,000 euros against the developer of the reform of the Formentor hotel for demolishing the structure without a licence. Inmobiliaria Formentor S.A. has 15 days to present allegations against the sanction
The Ajuntament de Pollença has opened a sanctioning file to the promoter of the reform of the hotel Formentor for having demolished the establishment without a license. The Consistory maintains that the building permits granted provided for the renovation and expansion of the hotel, but not the demolition. Therefore, it establishes a proposed penalty of 293,919.60 euros.
After reviewing the urban planning document of the hotel Formentor, the City Council has decided to open a file because it understands that the construction company “failed to comply with the current urban planning regulations. Specifically, the Llei d’Urbanisme de les Illes Balears”, which states that “the carrying out of construction, building, installation or earthmoving works in urban or developable land without the mandatory urban planning title will be punished with a fine of 50 to 100% of the value of the works”.
Thus, the mayor of Pollença, Martí March, has signed the resolution of the file against the developer, the corporation Inmobiliaria Formentor, for illegal demolition of the structure, without the relevant municipal license.
This developer was bought a few years ago by Emin Capital, the investment fund that owns the Formentor Hotel, which is promoting the reform to convert it into a luxury hotel establishment of the Four Seasons chain.
Inmobiliaria Formentor now has a period of 15 days to present allegations against the sanction. If they are not presented, the sanction will be considered a resolution proposal.
