The <strong>Consell de Mallorca<\/strong> opened <strong>146 proceedings between January and July<\/strong>, compared with 104 during the whole of 2025. This represents an <strong>increase of 40%<\/strong>, even though this year&#8217;s figures cover <strong>just seven months<\/strong>.<\/p>\n<p>Proposed fines associated with these new proceedings amount to <strong>\u20ac4,373,415<\/strong>. In addition, <strong>61 cases<\/strong> were resolved during the first seven months of the year, with fines totalling more than <strong>\u20ac2.1 million<\/strong>.<\/p>\n<h2>More than \u20ac4 million in proposed fines<\/h2>\n<p>Of the 61 proceedings resolved up to July, <strong>36 involved very serious offences and 25 serious offences<\/strong>. A total of 111 cases were resolved throughout 2025, meaning that more than half that figure had already been reached in the first seven months of 2026.<\/p>\n<p class=\"PDq2pG_selectionAnchorContainer\" dir=\"auto\" data-start=\"294\" data-end=\"504\">Regulations have also increased the fines for illegal tourist rentals in Mallorca. Under Decree Law 4\/2025, penalties now range <strong data-start=\"441\" data-end=\"473\">from \u20ac50,000 to \u20ac500,000<\/strong>, depending on the offence.<\/p>\n<p dir=\"auto\" data-start=\"506\" data-end=\"836\">The Consell de Mallorca&#8217;s councillor for Tourism, <strong data-start=\"555\" data-end=\"573\">Guillem Ginard<\/strong>, said the priority is to ensure &#8220;the removal, as soon as possible, of any advert promoting illegal tourist accommodation in Mallorca&#8221;. Once the offence has been established, he added, those responsible will have to pay the corresponding fine.<\/p>\n<p dir=\"auto\" data-start=\"838\" data-end=\"1035\" data-is-last-node=\"\" data-is-only-node=\"\">Ginard insisted that &#8220;there is no place in Mallorca for illegal tourist accommodation&#8221; and said the Consell would devote the necessary resources to detecting it, ordering it to cease and imposing penalties.<\/p>\n<h2>60 proceedings to shut down illegal tourist accommodation<\/h2>\n<p>One of the main developments in 2026 is the implementation of the <strong>Declaraci\u00f3 d&#8217;Il\u00b7legalitat de l&#8217;Activitat (DIA, Declaration of Illegal Activity)<\/strong> procedure. Since it was introduced in January, <strong>60 procedures have been initiated and 54 resolved<\/strong>, all resulting in orders to cease the activity.<\/p>\n<p>The mechanism is designed to speed up the removal of adverts for illegal tourist accommodation in Mallorca. Once an irregular listing is detected, those responsible are informed that they must cease the activity and remove the advert from accommodation platforms.<\/p>\n<p>If the advert is not removed within <strong>10 days<\/strong>, coercive measures in the form of fines may begin to be imposed. If the breach continues, the case may ultimately be referred to the Public Prosecutor&#8217;s Office.<\/p>\n<p>The aim is to stop the activity without waiting for the entire sanctioning procedure to be completed. At the end of 2025, the Consell had already announced the introduction of mechanisms designed to reduce response times in tackling illegal tourist accommodation.<\/p>\n<h2>More than 1,500 inspection visits up to July<\/h2>\n<p>The campaign against illegal tourist accommodation has been stepped up for the third consecutive summer during the period from <strong>15 May to 15 November<\/strong>. By July, inspectors had carried out <strong>1,546 visits<\/strong>.<\/p>\n<p>Inspections cover tourist rental properties, establishments that have been inactive for the past five years and tourist guides. Checks are also carried out for possible cases of overcrowding, cancelled tourist stays and excess tourism.<\/p>\n<p>Controls on <strong>tourist guides<\/strong> have been particularly strengthened during 2026, while inspections are also expected to increase to ensure compliance with the requirement for <strong>3% local produce<\/strong>.<\/p>\n<h2>How to report an illegal tourist rental in Mallorca<\/h2>\n<p>Anyone who detects a potentially illegal tourist property or activity can file a report with the Consell de Mallorca&#8217;s Tourism Department.<\/p>\n<p>The official channel received <strong>450 reports from members of the public during 2025<\/strong>.
